LAKEWOOD MUNICIPAL COURTS AGREEMENT FOR ELECTRONIC ACCESS TO COURT DATA

ANY PERSON DESIRING TO ACCESS THE LAKEWOOD MUNICIPAL COURT DATABASE MUST FIRST READ THIS AGREEMENT IN FULL AND AGREE TO THE TERMS AND CONDITIONS HEREIN


The City of Lakewood (the “City”), in compliance with Sections 13-1-119.5, 19-1-303, 19-1-304 and 19-1-307, C.R.S, and Part 7 of Title 24, Article 72, C.R.S, requires any person seeking access to electronic read-only court data to read and accept the following legally binding language:

The undersigned, who is seeking access to the Lakewood Municipal Court’s (the “Court”) Electronic Data, hereby agrees to these terms and conditions and represents as follows:

  1. I am a person authorized by statute to access Electronic Court Data.
  2. I am seeking access to the Court’s Electronic Data as allowed by statute.
  3. I am accessing a database containing confidential Court records that are not for public dissemination or use.
  4. I am responsible for complying with federal and state statutes and court rules regarding the confidentiality and use of these Court records.
  5. I understand and agree that the information and Court records I obtain are to be used only for the limited purposes authorized by law to conduct business pertaining to my work as one of the following:
    1. An authorized government user;
    2. An attorney of record for a defendant charged in the Court;
    3. An attorney or guardian ad litem of record for any juvenile or any parent or guardian of the juvenile;
    4. A Guardian ad Litem
    5. An attorney under contract as Alternate Defense Counsel.
  6. I understand that any personal use of this database or use not authorized by law is prohibited.
  7. I understand and agree that any violation regarding the use of the Court records and information obtained under this Agreement may result in any one or more of the following:
    1. Loss of access to electronic court records;
    2. A report to the Office of Attorney Regulation;
    3. Other professional discipline;
    4. Loss of employment and/or loss of contract work.
  8. I acknowledge that the use of this database may be monitored by the City and the Office of the State Court Administrator through audits or review of ad hoc queries or reports. This monitoring is not prohibited by attorney-client privilege.
  9. I understand that access to records at the Court is governed by other statutes.
  10. I understand that I must change my password every 90 days and that I am responsible for keeping track of my password. I will not share my password or User ID with others.
  11. INDEMNIFICATION: To the maximum extent allowable by law, I agree to indemnify and hold harmless the City, or other authorizing government agency, and their employees and agents against any and all claims, damages, liability and court awards, including costs, expenses and attorney fees, incurred as a result of any act or omission by me, or my employees, agents, subcontractors or assignees, related to accessing the database pursuant to this Agreement.
  12. I understand that if I am acting as an employee, I have authority to bind my employer to this Agreement and I agree that this Agreement will bind my employer.
  13. By clicking on the “I Accept” button, I agree to be legally bound by all terms and conditions in this Agreement.
